Please READ and COMPLETE this form before participating in any e-scooter activity

By hiring and operating an e-scooter from Gippsland Holidays, you acknowledge and accept the terms below and agree to operate the equipment in compliance with Victorian road rules, as outlined by the State Government of Victoria.

You agree and declare that:

• You are at least 16 years of age (as per Victorian e-scooter laws).
• You hold a valid driver’s licence OR understand you are required by law to obey all road rules applicable to a motorised personal mobility device in Victoria.
• You will wear a helmet at all times while riding the e-scooter (a helmet is provided as part of your hire).
• You will not ride on footpaths (only permitted on bike lanes, shared paths, and low-speed roads ≤ 60km/h, where allowed by law).
• You will not carry passengers on the e-scooter.
• You will not ride under the influence of alcohol or drugs (other than prescribed medications).
• You are aware of your personal physical capabilities and limitations.
• You accept full responsibility for monitoring and supervising any children in your care during the hire period (children are not permitted to operate the e-scooter).
• You agree not to tamper with, alter, or modify the e-scooter in any way.
• You agree to return the e-scooter in the condition it was received (clean, undamaged, and fully functional).

You acknowledge and accept:

There are inherent risks associated with the use of electric scooters and other outdoor mobility equipment, including but not limited to:

• Collision with vehicles, pedestrians, fixed objects, or uneven surfaces
• Mechanical failure, falls, or personal injury
• Damage to property or injury to third parties

You accept that:

• You assume all responsibility and risk associated with the use of the e-scooter
• Gippsland Holidays (W.C. & A.J. Geisler), its owners, agents, employees, and partners are not liable for any injury, accident, damage, or loss resulting from your use of the equipment, except where required by law
• Any loss, theft, or damage to the equipment while in your possession is your responsibility and may incur repair or replacement charges

Indemnity and Release

By signing this agreement, you:

• Release, discharge, and indemnify Gippsland Holidays, W.C. & A.J. Geisler, and their owners, agents, and staff from all liability, claims, demands, or legal action arising from use of the e-scooter or breach of these conditions
• Accept that you are financially liable for any damage, fines, or breaches of Victorian law incurred during the hire period
• Agree that this waiver is binding and covers yourself and any party under your supervision
