GIPPSLAND HOLIDAYS – LAWN GAMES HIRE AGREEMENT & WAIVER OF LIABILITY

By proceeding with a booking, you acknowledge and accept the following Terms & Conditions.

1. Hire Agreement
   Gippsland Holidays agrees to provide outdoor lawn games for hire for the agreed duration and fee, as outlined at the time of booking.
2. Entire Agreement
   This document represents the full understanding between Gippsland Holidays and the hirer, superseding any prior verbal or written agreements. No verbal promises or representations are binding unless confirmed in writing.
3. Booking Confirmation & Payment
   A deposit is required to confirm your booking. We reserve the right to cancel any unconfirmed bookings. Full payment must be received within the timeframes specified on our website.
4. Use of Equipment

• Games must only be used at the designated hire location and must not be sub-hired or relocated without written permission from Gippsland Holidays.
• All equipment must be used solely for its intended recreational purpose and as instructed.
• Games must not be used in any way that could cause injury or damage to people or property.

5. Responsibility & Risk

• Responsibility for the equipment passes to the hirer at the time of possession and remains with them until it is returned.
• The hirer is fully responsible for any damage, loss, or theft of equipment during the hire period, excluding instances proven to be due to negligence on the part of Gippsland Holidays.
• Any damage caused by third parties must be reported immediately.

6. Condition of Equipment

• Equipment must be returned in a clean, dry, and reasonable condition.
• You must inspect all equipment within 30 minutes of receiving it and report any missing pieces or faults.
• Any issues or failures during the hire period must be reported immediately so we can arrange repair or replacement, where possible.

7. Weather Considerations

• Hirers are responsible for protecting the equipment in adverse weather. Refunds or substitutions are not guaranteed in the event of bad weather.

8. Late Returns & Fees

• Equipment not returned by the agreed time may incur additional daily hire charges.
• A security bond may be held and is refundable upon timely and damage-free return of all items.
• Any additional charges for damage, cleaning, or late return will be invoiced and may incur interest if unpaid after the due date.

9. Assistance & Delivery

• Assistance with loading or unloading may be offered at our discretion.
• If delivery is arranged, additional fees apply for multiple delivery attempts or extended wait times.
• Delivery and set-up times will be adhered to as closely as possible.

10. Variations & Termination

• Hire variations (e.g., changes to equipment or dates) may be permitted, subject to availability.
• The hire agreement terminates once all items are returned, and any outstanding amounts are paid.

11. Communication
    Email correspondence is accepted as a formal method of communication under this agreement.
12. Legal Conditions

• All statutory warranties and conditions implied by law are excluded to the fullest extent permissible.
• If any term of this agreement is found invalid, the remainder remains enforceable.
• Gippsland Holidays accepts no liability for injury or damage incurred during the use of our lawn games.
• All parties agree to attempt mediation prior to any legal proceedings.
• Gippsland Holidays will not be held liable for any failure or delay caused by events beyond our control.

By booking and/or using our lawn games, you agree to these Terms & Conditions and accept full responsibility for the care, safe use, and timely return of the hired equipment.
