Gippsland Holidays – Terms & Conditions

Effective as of 2025

By confirming a booking with Gippsland Holidays, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions.

These terms apply to all properties and hire services operated by Gippsland Holidays and are governed by the laws of the State of Victoria and Australian Consumer Law.

Prices, availability, and policies are subject to change without notice. Images are for illustrative purposes only.
Any property or service with specific or additional terms will have those conditions listed on its individual webpage.


1. Booking & Payment

To secure a reservation, guests must provide a valid credit card, which will be securely stored on file and may be used for payment in accordance with these Terms & Conditions.

Alternatively, bank deposit (direct transfer) is accepted; however, a valid credit card is still required to be held on file for security purposes.

No booking deposit is required.
The full balance is due 7 days prior to arrival unless otherwise stated at the time of booking.

If payment is not received by the due date, Gippsland Holidays reserves the right to charge the outstanding balance to the credit card on file or cancel the booking.

All bookings must be made by a person 18 years or older, who accepts full responsibility for the reservation and all occupants.


2. Payment Methods & Surcharges

We accept payment via:

  • Credit Card (Visa, Mastercard)

  • Direct Deposit (Bank Transfer)

A credit card must be provided at the time of booking, even if another payment method is used.

Credit card processing surcharges may apply.

For payments made via Stripe online payment links, any refund issued due to:

  • Incorrect orders

  • Booking errors made by the guest

  • Change of mind

will incur a 2.2% non-refundable processing fee, reflecting transaction costs charged to Gippsland Holidays.

Gippsland Holidays reserves the right to charge the guest’s credit card on file for any unpaid balances, damages, excessive cleaning, hire equipment issues, or policy breaches. Guests will be notified of any charges outside the agreed rate.


3. Booking Approval via Website

Some bookings may require management approval. Selecting “Approval by Management” at checkout does not confirm a booking. Our team will contact you to confirm or offer alternative availability.


4. Cancellation Policy

  • More than 7 days prior to check-in: Full refund

  • Within 7 days and up to 24 hours before check-in: No refund of any payments made

  • Within 24 hours, no-shows, or early departures: No refund

We strongly recommend travel insurance to cover unforeseen changes.


5. House Rules

  • Only registered guests are permitted on the premises unless prior approval is granted

  • Quiet hours are strictly enforced between 10:00pm and 8:00am

  • Guests must comply with all local council laws and property by-laws

  • Smoking or vaping indoors is strictly prohibited

    • Breach incurs a $200 fine plus additional cleaning costs


6. Extra Services & Early/Late Check-outs

Early check-in and late check-out requests must be submitted at least 24 hours in advance, are subject to availability, and may incur a fee. Guests must contact Gippsland Holidays directly to request and confirm these services.


7. Occupancy & Guest Responsibilities

  • Occupancy applies only to the confirmed booking dates

  • Vehicles must park in designated areas

  • Overnight guest numbers must not exceed the booked occupancy

  • Guests are responsible for all damage, breakage, or loss

Additional charges may apply if:

  • Extra bedrooms are used without approval

  • Excessive cleaning is required

  • Furniture is moved or the property is left in an unreasonable condition


8. Lost Property

Items left behind will be held for 7 days before being donated to charity.
Postage fees apply if return is requested.
Perishable items will be discarded immediately.

Gippsland Holidays accepts no responsibility for lost or forgotten items.


9. Security Deposit & Property Inspections

A refundable security deposit may apply to certain bookings.

Refunds are processed following inspection, provided there is no damage, excessive cleaning, or breach of these Terms & Conditions.

Management reserves the right to inspect a property with reasonable notice, or immediately if a breach is suspected. Guests authorise charges to their card on file where applicable.


10. Liability & Disclaimer

Gippsland Holidays and its property owners accept no liability for injury, loss, theft, weather-related events, or accidents during a guest’s stay. Guests are responsible for the safety and security of all occupants and personal belongings.


11. Check-out & Digital Access

  • Standard check-out time is 10:00am

  • Late check-out must be approved by management at least 24 hours in advance

All properties operate with digital lock access.
Guests are responsible for the secure use of access codes. Sharing access codes with non-registered guests is strictly prohibited and may result in additional charges or cancellation.


12. Property Allocation & Views

While every effort is made to accommodate guest preferences, Gippsland Holidays reserves the right to reallocate apartments if required for operational reasons.

Please note: 1st Floor Spa Deluxe Apartments have resort views only. Water views are not guaranteed.


13. Pet Policy

Pets are not permitted at Captains Cove Resort – Waterfront Apartments.

Pet-friendly accommodation is available at Captains Edge.

Registered service and guide dogs are welcome with supporting documentation provided prior to arrival.


14. One-Night Stays

One-night stays are subject to availability and incur a short-stay surcharge. Seasonal or event-based conditions may apply.

Gippsland Holidays – Hire Terms & Conditions

By hiring equipment from Gippsland Holidays, you acknowledge that you have read, understood, and agreed to the following Hire Terms & Conditions.
These terms apply to all hire equipment provided by Gippsland Holidays and operate alongside Australian Consumer Law and the laws of the State of Victoria.


1. Hire Agreement & Eligibility

All hire equipment is hired to a responsible person aged 18 years or older, who accepts full responsibility for the equipment during the hire period.

Proof of identity may be requested. Gippsland Holidays reserves the right to refuse hire at its discretion.


2. Payment & Booking

Full payment is required prior to collection or commencement of hire.

Payment is accepted via:

  • Credit Card (Visa, Mastercard)

  • Stripe online payment links

  • Cash payment at reception 

A valid credit card must be provided and securely stored on file for security and damage purposes.


3. Cancellations, Changes & Refunds

Refunds are not guaranteed and are assessed in accordance with Australian Consumer Law.

For hire bookings paid via Stripe payment links, any refund issued due to:

  • Incorrect orders

  • Booking errors made by the customer

  • Change of mind

will incur a 2.2% non-refundable processing fee, reflecting transaction costs charged to Gippsland Holidays.

No refund is provided for:

  • Late arrivals or early returns

  • Weather-related decisions made by the hirer

  • Failure to collect equipment at the agreed time


4. Hire Period & Returns

Hire periods commence and conclude at the agreed times.

All equipment must be:

  • Returned on time

  • Returned to the agreed location

  • In a clean, safe, and undamaged condition

Late returns may incur additional hire fees.


5. Equipment Condition & Responsibility

The hirer acknowledges that equipment is supplied in good working order at the commencement of hire.

The hirer is responsible for:

  • Any loss, theft, or damage

  • Damage caused by misuse, negligence, or failure to follow instructions

  • Repair or replacement costs where applicable

Gippsland Holidays reserves the right to charge the hirer’s credit card on file for repair, replacement, or additional cleaning costs.


6. Safe Use & Instructions

Hired equipment must be used:

  • Only for its intended purpose

  • In accordance with any instructions or safety briefings provided

  • In suitable weather and water conditions

The hirer agrees not to:

  • Modify or tamper with equipment

  • Allow unapproved users to operate equipment

  • Use equipment while under the influence of drugs or alcohol


7. Weather & Environmental Conditions

Gippsland Holidays is not responsible for hire disruptions due to weather, wind, tides, or environmental conditions.

The decision to proceed with hire in prevailing conditions rests solely with the hirer once equipment has been issued.


8. Liability & Risk Acknowledgement

The hirer acknowledges that participation in outdoor and water-based activities involves inherent risks.

To the maximum extent permitted by law, Gippsland Holidays is not liable for:

  • Personal injury or death

  • Loss or damage to personal property

  • Accidents or incidents arising during the hire period

The hirer accepts full responsibility for their own safety and the safety of all participants.


9. Cleaning & Damage Charges

Equipment returned excessively dirty, damaged, or unsafe may incur:

  • Additional cleaning fees

  • Repair costs

  • Full replacement costs where damage is beyond repair

These charges may be applied to the credit card held on file.


10. Breach of Terms

Failure to comply with these Hire Terms & Conditions may result in:

  • Immediate termination of hire

  • Forfeiture of hire fees

  • Additional charges for damage or loss


11. Governing Law

These Hire Terms & Conditions are governed by the laws of the State of Victoria and Australian Consumer Law.
